JUSTICE ARUN KUMAR JHA ORAL ORDER 12-09-2025 The instant petition has been filed for initiation of contempt proceeding against the opposite parties for violation and willful disobedience of order dated 19.01.2024 passed by this Court in Civil Miscellaneous Jurisdiction No. 380 of 2021.

Vide order dated 19.01.2024, this Court directed the parties to maintain status quo over the disputed property during the pendency of the suit before the learned trial court and the learned trial court was directed to make all efforts to conclude the trial within six months of receipt/production of the order without getting influenced by any of the observation made by
Patna High Court MJC No.525 of 2024(8) dt.12-09-2025 2/3 this Court.
3. The grievance of the petitioner is that the opposite parties have cut the wire which has fenced the suit land. Learned counsel further submits that the intimation was given to the SHO of Barh police Station on 24.01.2024 but no steps have been taken.
4. After issuance of the notice, opposite party nos. 2 and 3 appeared and filed their show cause. In the show cause they have submitted that there is no evidence to show that the opposite parties have done any act which can be said to be the contempt of the court and the present petition has been filed with false and concocted allegations. It has also been submitted in the show cause that the present contempt petition has been filed by the petitioner with oblique and ulterior motive and hence, the contempt petition may be dismissed with cost.

Learned counsel appearing on behalf of the petitioner submits that now the matter has reached to the stage of final disposal before the learned trial court, the petitioner is not pressing the present contempt petition and prays for disposal with a direction to the learned trial court to dispose of the title suit at the earliest.
6. In the light of submission made on behalf of the
Patna High Court MJC No.525 of 2024(8) dt.12-09-2025 3/3 petitioner, the learned trial court is reminded of the order of this Court dated 19.01.2024. It is also surprising that despite specific order of this Court, the learned trial court has not sought extension of time and has kept the matter pending till date and for this reason, it is incumbent upon the learned trial court to show urgency for disposal of the matter and dispose of the same within two months from the date of receipt/production of a copy of this order.
7. With the above observation and direction, the present petition stands disposed of.
