The petitioner is accused in connection with Sugauli P.S. Case No. 184 of 2016, registered under Sections 363, 365, 366(A) and 504/34 of the Indian Penal Code.
The accusation is of kidnapping of Mala Kumari, aged about 12 years, daughter of the informant, Turisa Kumari, aged about 11 years, Nanad of the informant and Rahul Kumar, aged about 14 years, brother-in-law of the informant Punita Devi by her driver Azaz Mian with the help of his family members. Learned counsel for the petitioner submits that, in fact, the petitioner is the brother-in-law of the informant and due to land dispute the petitioner and Rahul Kumar have falsely been
Patna High Court Cr.Misc. No.3935 of 2017 (2) dt.27-02-2017 2/2 implicated in this case. Further submission is that it would appear from the statement of Turisha Kumari and Mala Kumari recorded under Section 164 of the Cr.P.C. that they were accompanied by victim Rahul from Sugauli to Chhapra, where petitioner met and handed over Rs. 10,000/- to victim Rahul, who accompanied both from Patna to Ludhiyana, where Pankaj Kumar, father of the victim, and his wife reached and take them back to the house. Further submission is that petitioner is in custody since 01.10.2016 and Chargesheet has also been submitted against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S. Case No.184 of 2016.
