This application is for grant of bail in connection with Tandwa P.S.Case No.31 of 2010 for the offence under Sections 302, 324,201 and 120B of the Indian Penal Code. It is submitted on behalf of the petitioner that the petitioner has been made accused in this case only on the basis of suspicion. He is in custody since 29.07.2016. It has fairly been submitted in this case that now the trial has also been started and three witnesses have been examined and these witnesses have been declared hostile of the prosecution as they have not supported the case of the petitioner.

Heard learned A.P.P. also.

Having heard both sides and from perusal of the impugned

Patna High Court Cr.Misc. No.7181 of 2017 (2) dt.22-02-2017 2/2 order itself, it appears that incriminating articles have been recovered from the house of the petitioner and coupled with the fact that the petitioner is accused in a large number of cases, as mentioned in Para no.3 of the petition.

Considering the aforesaid aspects of the matter, I am not inclined to grant bail to the petitioner at this stage, however, considering the fact that three witnesses have already been examined, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. With the aforesaid observation, this application is dismissed.
