JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-02-2017 The petitioner is in custody since 13.12.2016 in connection with Madhepura Mahila P.S. Case No. 63 of 2016, (G.R. No. 1557 of 2016) registered for offences punishable under Sections 498(A), 341,323, 504, 506 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is ready to keep his wife with full honour and dignity. Heard learned A.P.P. and learned counsel for opposite party no. 2. Learned counsel for opposite party no. 2 has submitted that the opposite party no. 2 is also ready to live with the petitioner.

In such view of the matter, the petitioner is directed to renew his prayer for bail before the Court below on 21.02.2017

Patna High Court Cr.Misc. No.5789 of 2017 (2) dt.15-02-2017 2/2 with a prayer to keep his wife with full honour and dignity, on which date opposite party no. 2 shall also present herself, and learned court below on being satisfied with the aforesaid prayer shall enlarge him on provisional bail for a period of six months to his satisfaction and shall also watch their conduct by calling them each month for six months and only after being satisfied himself with the conduct of the petitioner during the aforesaid period, shall confirm the provisional bail of the petitioner, otherwise he is free to pass any order as he deems fit.

With the above observation, this application is disposed of.
