The Petitioner seeks bail in Bhagwanpur P.S. Case No. 180 of 2016 instituted for the offence under Sections 8 and 20(b)(ii) (B) of the Narcotic Drugs and Psychotropic Substance Act.
As per the written report 10 Kgs. Ganja has been recovered from the possession of the petitioner. The seizure list bears the signature of this petitioner.
The Case Diary has been received. The witnesses have supported the case of the informant of recovery of Ganja from the possession of the petitioner. Therefore, this Court is not inclined to grant bail to the petitioner. The prayer is rejected at this
Patna High Court Cr.Misc. No.19903 of 2017 (3) dt.19-05-2017 2/2 stage.
The Trial Court is directed to expedite the trial by making efforts to conclude the same as early as possible preferably within a period of nine months.
The petitioner is given liberty to renew his prayer for bail in the court below itself after nine months, if the trial is not concluded within the aforesaid period.
In that event the Court below will give reason for not concluding the trial within nine months.
