Petitioner seeks bail in a case registered for the offences punishable under Sections 328 and 302 of the Indian Penal Code.
Petitioner is suspected to have administered poison to the son of the informant resulting in his death. Submission is that there is no other material, except suspicion, nor there is any motive against the petitioner to administered poison to the son of the informant. Only reason was that he was along with the deceased and that is why he has been made accused in the case. Investigation of the case is already complete.
Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.11073 of 2019(3) dt.03-05-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Habibpur Police Station Case No.104 of 2017, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
