The petitioner is apprehending arrest in a case registered for the offences punishable under sections 386/34 of the Indian Penal Code.
The prosecution case is that two accused persons came on a Bolero vehicle claiming themselves to be Mobile Magistrate and snatched two thousand rupees from the informant. Though the FIR was lodged against unknown but during investigation it transpired that the petitioner is the owner of the vehicle in question.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.3882 of 2016 (2) dt.27-01-2016 2/2 petitioner that the vehicle in question being a public carrier was being driven by the driver. There is nothing on record to show that the petitioner was present in the Bolero vehicle at the time of occurrence.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Turkaulia P.S. Case No. 640 of 2015 pending in the court of learned CJM, Motihari. This application is disposed of with the aforesaid observation/direction.
