JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 316 and 498 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of the dowry demand. It is also alleged that due to assault, premature pregnancy of the informant got terminated.

It is submitted by learned counsel for the petitioner that the accusation against the petitioner is omnibus and general and the thrust of accusation is against the husband of the informant. Since the case was registered in the year 2004 and the anticipatory bail application has been preferred in the year 2016, this Court is not inclined to interfere.

No.4027 of 2016 (2) dt.27-01-2016 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if she surrenders within a period of six weeks in connection with Jamui P.S. Case No. 47 of 2004 pending in the court of learned ADJ-III, Jamui. Accordingly, the application is disposed of.
