The petitioner has preferred this application for grant of regular bail in a case registered under section 393 of the Indian Penal Code.

As per the prosecution case, three accused persons are stated to have resorted to indiscriminate firing at the customers service point as a result of which one Rajendra Rai sustained injury in his leg.

It is submitted by learned counsel for the petitioner that the FIR was registered against three unknown. The petitioner who was falsely implicated in one another case i.e. Baruraj P.S. Case no. 93 of 2020 is stated to have given a confessional statement in the said case about his involvement in different cases including the present one. He was remanded in

Patna High Court CR. MISC. No.20579 of 2021(3) dt.15-11-2021 2/2 the instant case on 30.9.2019. It is further submitted that subsequently in course of investigation one of the persons claims to be an eye witness to the occurrence, however, inspite of having remained in custody for over one year the petitioner has not been put on T.I. Parade Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the submissions made on behalf of the petitioner together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Sahebganj P.S. Case no. 270 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M- I (W), Muzaffarpur.
