This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 302 and 34 of the Indian Penal Code, registered in connection with Akbarpur P.S.Case No. 433 of 2021.

The informant, the deceased and the petitioner are own brothers. As per allegation, the petitioner Pappu Rajbanshi, his wife Sunita Devi entered into the house of the informant and they assaulted Pradeep Rajbanshi on his head with iron rod. They also assaulted Santosh Rajbanshi. Pradeep Rajbanshi died in the PMCH in course of treatment.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.12613 of 2023(2) dt.15-05-2023 2/2 that the petitioner is innocent and has falsely been implicated in this case.

There is specific allegation against the petitioner that he and his wife Sunita Devi committed murder of Pradeep Rajbanshi in sleeping state by assaulting with iron rod. It appears that the bail application of Sunita Devi has been rejected by a coordinate Bench of this Court in Cr.Misc. No.29969 of 2022.

In my view, it is not a fit case to grant the privilege of bail to the petitioner. It is accordingly rejected. (Nawneet Kumar Pandey, J) HR/- U T
