JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,420,467,468,471 and 506 of the Indian Penal Code.
The prosecution case is that the land of the informant was being transferred by Rambadan Singh through registered sale deed in favour of the petitioner.
It is submitted by the learned counsel for the petitioner that that the petitioner is a bonafide purchaser after making payment of consideration amount to Rambadan Singh who is agnate of the informant.
Considering the fact that the petitioner is a purchaser and a lady coupled with the statement made in paragraph 3 of the
Patna High Court Cr.Misc. No.4095 of 2016 (2) dt.29-01-2016 2/2 petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Rafiganj P.S. Case No.138 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
