Petitioner is in custody since 12.05.2016 in connection with Lakshmipur P.S. Case No. 70 of 2015 registered under Sections 392 and 395 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. and merely on the basis of confessional statement of the co-accused, Ganauri Yadav, name of this petitioner has surfaced in this case. Nothing has been recovered from the conscious possession of the petitioner. No T.I.P. has been conducted in this case as yet. The petitioner is rotting in custody for the last nine months.

Considering the nature of accusation, let the petitioner,

Patna High Court Cr.Misc. No.12297 of 2017 (2) dt.30-03-2017 above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Lakshmipur P.S.
