2. The petitioner seeks bail in connection with Saraiya P.S. Case No. 226 of 2024 registered for the offence punishable under Sections 302/34 of the Indian Penal Code. He is in custody since 30.05.2024.

3. The petitioner is the husband of the deceased. The accused persons are accused of killing the deceased. Paragraph No. 8 of the bail petition reads as follows:- "That it is alleged that the marriage was solemnized in 2015 and they were leading happy conjugal life and from wedlock 3 children were born namely (1) Ashu Kumar aged about 7 years, (2) Ankush Kumar aged about 5 years and Arun Kumar aged about 3 years. It shows there was cordial relation between petitioner and the wife (deceased)."

4. Considering the period of custody, this application is allowed.

5. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 16th Additional Sessions Judge, Muzaffarpur/concerned court in connection with Saraiya P.S. Case No. 226 of 2024.

6. At the time of accepting bail bond, the court below will verify the fact as to whether the petitioner has three children and they are staying with him. If the statement is found correct, the bail bonds of the petitioner shall be accepted and if the statement is found false, the bail bonds of the petitioner shall not be accepted.
