JUSTICE SANJAY KUMAR ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

The petitioner seeks regular bail in connection with Triveniganj P.S. Case No. 204 of 2016 registered for the offences punishable under Section 307 of the Indian Penal Code and Sections 25(1-B)A, 27 of the Arms Act.

The allegation against the petitioner is that he was apprehended by the villagers on chase when he attempted to cause firearm injury on the informant.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The villagers allegedly produced the firearm before the police and in the alleged occurrence, the informant has not

Learned counsel further submits that the petitioner is in custody since 24.09.2016 and other co-accused has already been allowed bail by the learned court below. Learned APP for the State opposed the prayer of bail. Considering the facts and circumstances of the case and also the fact that other co-accused has already been allowed bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Supaul in connection with Triveniganj P.S. Case No. 204 of 2016.
