Counsel for the State relying upon the pleadings made in the counter affidavit submits that the petitioner is not entitled to grant of 3rd ACP as he refused to accept the promotion granted to him on the post of Assistant from Upper Division Clerk under office order dated 01.02.2010 issued by the Deputy Secretary, Department of Personnel and Administrative Reforms, Government of Bihar.

Without going into the merits of the said submissions, since none appears for the petitioner, writ petition is dismissed
