The petitioners seek bail in a case instituted under Sections 467, 468, 471, 419, 420, 120B of the Indian Penal Code and Section 14 of the Foreign Act.
Allegation against the petitioners is that they are from Bangladesh and they were trying to get a fake Indian Passport prepared.
Earlier the bail application of the petitioners was rejected vide Annexure-1 to the present application taking into account that the petitioners are the resident of Bangladesh and they were trying to get a fake Indian Passport prepared. Such cases relate to the national security threats to the India. A report was called for from the trial court
Patna High Court Cr.Misc. No.14578 of 2017 (3) dt.20-04-2017 2/2 regarding the stage of the case and it has been reported that charge has already been framed on 31.04.2016 and the case is pending for evidence. No witness has been examined in this case. The court has issued summons against all the charge sheeted witnesses.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioners. The same is rejected in S.T. No. 4674 of 2015, arising out of Shastri Nagar P.S. Case No. 523 of 2015, pending in the court of Mrs. Aditi Gupta, learned Judicial Magistrate, 1st Class, Patna. The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of copy of this order. The District Magistrate, Patna and the Senior Superintendent of Police, Patna are directed to ensure that the prosecution witnesses are produced in the court on the date fixed by the court below, so that the trial could be concluded within the stipulated period, as indicated by the court below.
