JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sasaram (Tilauthu) P.S. Case No. 1227 of 2015 instituted for the offence under Sections 364/34 of the Indian Penal Code.

It has been submitted that initially the police after investigation submitted Final Report in this case. Thereafter, cognizance has been taken by the learned Magistrate on the basis of allegation after differing with Final Report submitted by the Police.

In the written report it is alleged that Pintu Sao and other accused persons had kidnapped the daughter of the informant. The statement of the victim girl was recorded under Section 164 Cr. P.C. wherein she has clearly stated that she had

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Tilauthu) P.S.
