The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323 and 354/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that the informant being a Block Pramukh was holding meeting in the officer of the Circle Officer on 30.4.2015 when all the accused persons entered into the
Patna High Court Cr.Misc. No.4088 of 2016 (2) dt.29-01-2016 2/2 office and started humiliating the informant by abusing calling the caste name and threatened of dire consequences. It is further alleged that the accused persons also made attempt to outrage the modesty.
It is submitted by the learned counsel for the petitioners that frivolous case has been lodged since the petitioners made protest for sanctioning road through their land. Considering the nature of accusation, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case they surrender within six weeks from today in connection with Hussainganj P.S. Case No. 84 of 2015 pending in the court of learned CJM, Siwan.
This application is disposed of with the aforesaid observation/direction.
