JUSTICE SANDEEP KUMAR ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and learned Additional The petitioner apprehends his arrest in connection with Malaypur P.S. Case No. 58 of 2021 registered for the offence under Sections 272, 273, 279 and 34 of the Indian Penal Code and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2018.

The illicit liquor was recovered from a car from which some persons were arrested with 90 litres of foreign liquor and all the accused persons, who were arrested, in their selfinculpatory confessional statements have named the petitioner as member of the syndicate involved in smuggling of illicit liquor from Jharkhand.

No.11202 of 2022(2) dt.01-04-2022 2/2 In view of the allegations levelled against the petitioner, this anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the case of Ram Binay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)]. Accordingly, it is dismissed as not maintainable.
