Petitioner is in custody since 18.12.2016 in connection with Bettiah Town P.S. Case No. 700 of 2016/ S.G.R. No. 43 of 2016 registered under Sections 376/511 of the Indian Penal Code and Section POCSO Act.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, neither any mark of violence was found on the person of the victim girl nor she has been medically examined. Eye witnesses have not supported the prosecution version. Moreover, charges have been framed in this case, which is evident from the supplementary affidavit filed by the petitioner. The petitioner is rotting

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge- 1st-cum- Special Judge, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 700 of 2016, S.G.R. No. 43 of 2016.
