The petitioner seeks bail in a case registered under Sections 363, 364, 365/34 of the Indian Penal Code. Allegation is that the accused persons abducted the informant's son, namely, Mantu Sahni.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.1.2020. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in this case merely on the basis of suspicion. There is no eye witness on the point of forceful abduction being committed by the miscreants. Except for this, there is no other substantive evidence to suggest the implication

Patna High Court CR. MISC. No.14594 of 2020(2) dt.03-03-2020 2/2 of the petitioner in this case. Other co-accused has been granted bail vide Annexure 2 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st (West), Muzaffarpur in connection with Sahebganj P.S. case No.311 of 2018.
