JUSTICE SANJAY PRIYA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(A) of Bihar Prohibition & Exercise Act. It has been submitted that the petitioner was labourer engaged in loading the cartons in truck. He has no concern with the seized cartons. He has clean antecedent and is in custody since 16.10.2016. It has further been submitted that co-accused Raushan Kumar Mahto with similar allegation who was arrested along with the petitioner, has already been allowed bail by a coordinate Bench of this Court vide order dated 2.2.2017 passed in Cr. Misc. 2357 of 2017.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.5009 of 2017 (2) dt.22-02-2017 2/2 the case, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Suvesh Kumar Roy, learned Judicial Magistrate, 1st Class, Muzaffarpur, subject to the condition that both the bailors will be the close relatives of the petitioner.
