Let the sections accordingly be corrected as per paragraph No. 2 of the supplementary affidavit.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/ 323/357/332/272/273/34 of the Indian Penal Code and Section 47(A) of the Excise Act.
Learned counsel for the petitioner submits that though there is an allegation of recovery of country-made liquor yet, nothing is said to have been recovered from the petitioner's conscious
Patna High Court Cr.Misc. No.4497 of 2016 (2) dt.22-04-2016 P2/2 possession. It is submitted on behalf of the petitioner that his name has been disclosed only on account of some political rivalry. Considering the aforementioned facts and circumstances and also the fact that the petitioner has a clean antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arrah, Bhojpur in connection with Koilwar P.S. Case No. 219 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
