JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 414 of the Indian Penal Code and Section 11 of the Prevention of Cruelty to Animal Act.
The prosecution case is that the petitioners were carrying five cows and three calf by tying their mouth and neck and thereby inflicting torture to the animals. The informant suspected that the stolen animals were being transported.
It is submitted by learned counsel for the petitioners that animals were validly purchased. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.4492 of 2016 (2) dt.02-02-2016 2/2 petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 205 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
