Prayer is made for adjournment of the case. In peculiar facts, the Court is not inclined to grant any indulgence and unnecessary adjournment as the instant case is pending for more than three years and the issue involved requires verification of record by the University.

The instant writ petition is filed for payment of difference of payment of arrears from March 1994 to February 2013.

The respondents have not filed any counter in the

Patna High Court CWJC No.12457 of 2015(2) dt.03-12-2018 2/2 matter where primarily the respondent-university has to verify the record and take appropriate decision.

Accordingly, the writ petition is disposed of with a direction to the University to verify the record and work out the entitlement of the petitioner for payment of difference of arrears of salary. Necessary decision in this regard may be taken by the University at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order.

Failing which the entire arrears will carry interest at the rate of 9 per cent per annum from March 1994 till the date of actual payment. Compensated interest shall be payable by the erring officer of the University from his own pocket. With the aforesaid the writ petition stands disposed of. (Anil Kumar Upadhyay, J) T.Kr./- U
