JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Sessions Trial No.529 of 2019, arising out of Bajpatti P.S. Case No.310 of 2019, registered under Sections 399, 402, 414 and 413 of the Indian Penal Code besides Sections 25(1-B) a, 26 and 35 of the Arms Act. The accusation is that in course of checking of the vehicles by the informant along with other police personnel, two motorcycles were seen. On one white colour motorcycle, three persons were sitting, whereas on another motorcycle, two persons were sitting. On giving the signal to stop the motorcycles, the persons, who were sitting on the motorcycles, started to flee away by accelerating the speed of the motorcycles. No.11827 of 2020(3) dt.15-06-2020 2/2 another motorcycle, two persons succeeded to flee away but one was apprehended, who, on query, disclosed his name as Vikas Kumar (petitioner). On search, he was found in possession of one country made pistol loaded with five live cartridges, one Magazine loaded with five live cartridges and one mobile set. Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody since 06.09.2019. Mr. Vikramdeo Singh, learned counsel appearing for the petitioner, submitted at the Bar that while the petitioner is accused in three other cases, as detailed in paragraph-3 to this application, but in all those cases, he is on bail.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI, Sitamarhi, in connection with Sessions Trial No.529 of 2019, arising out of Bajpatti P.S. Case No.310 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner.
