====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 255 of 2020, registered for the offence punishable under Section 302/34 of the Indian Penal Code, pending in the Court of learned Judicial Magistrate, 1st Class, Gopalganj.

Considering the allegation and seriousness of the charge, the petitioner, who has assaulted with Farsa on the person of the deceased Bhagwat Prasad. The informant is the eye-witness of the occurrence, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the prayer for grant of regular bail is rejected.

However, the learned trial Court is directed to

Patna High Court CR. MISC. No.21192 of 2021(7) dt.24-02-2022 2/2 conclude the trial expeditiously, well within a period of nine months. If no substantial progress takes place in trial, the petitioner, if so advised, may renew his prayer for bail after nine month.
