The petitioner seeks bail in connection with Sikty P.S. Case No.120/16 registered under Sections 272,273 of the Indian Penal Code and Section 47 of the Excise Act.

The accusation is that three persons who were on the motorcycle started to flee away on seeing the police party but two persons were apprehended with the motorcycle who disclosed their name as Munna Kumar Yadav and Pankaj Kumar Yadav. On search 88 bottles each containing 300 ml. Nepali liquor recovered. Both disclosed the name of this (petitioner) his associates succeeded in fleeing away as Arvind Kumar Sah. No.15046 of 2017 (2) dt.13-04-2017 2/2 petitioner was not arrested on the spot rather his name has been disclosed by co-accused and he is in custody since 23.12.2016.b Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Araria, in connection with Sikty P.S.Case No.120/16.
