JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 Petitioners seek bail in anticipation of their arrest in connection with Harnaut P.S. Case No. 71 of 2018 registered for the offences punishable under Sections 341, 323, 324, 325, 379 and 504/34 of the Indian Penal Code.

Allegation as per FIR is that while informant was returning the petitioners surrounded him, assaulted him and snatched Rs.50,000/- and mobile from him.

Submission of learned counsel for the petitioners is that there is inordinate delay in lodging the FIR and moreover the witnesses have not supported the allegation of snatching. However, they have categorically stated that occurrence took

In view of above facts and circumstances, let petitioners, in the event of surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Harnaut P.S. Case No. 71 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
