JUSTICE SANJAY PRIYA ORAL ORDER 06-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Maheshkhunt P.S. Case No. 02 of 2017, G.R. No. 23 of 2017 instituted for the offence under Sections 341, 323, 504 and 436/34 of the Indian Penal Code.

It has been submitted that there is general and omnibus allegation against the petitioner in the written report. There is specific allegation against co-accused Vilesh Das of setting hut of the informant on fire.

Case diary has been received.

Learned A.P.P. has pointed out about the injury report of the injured persons on page 13 to 17 of the case diary, wherein the doctor has found simple injury, except on the person of

Patna High Court Cr.Misc. No.11024 of 2017 (3) dt.06-04-2017 2/2 injured Dasrath Das and Kangresh Das against whom the opinion has been kept reserved.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Khagaria, in connection with Maheshkhunt P.S. Case No. 2 of 2017, G.R. No. 23 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
