2. The petitioner seeks bail in connection with Rupau P.S. Case No. 101/2025 registered for the offences punishable under Sections 80, 3(5) of the B.N.S.S.
3. As per the prosecution case, petitioner is the husband of the deceased and he is alleged to have killed the deceased for demand of dowry.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is next submitted that the petitioner was staying in Delhi for work and was not present on the date and place of occurrence and the family members of the deceased were informed by the family of her in-laws. Patna High Court CR. MISC. No.10370 of 2026(5) dt.16-04-2026 2/2 submits that the deceased fell down from the staircase and sustained head injury due to which she died and no external injury has been found over the body of the deceased and even the post-mortem report falsifies the prosecution. Learned counsel further submits that petitioner has clean antecedent and he is in custody since 11.08.2025. The petitioner undertakes to co-operate in the case/ trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IIIrd, Nawada /concerned Court below in connection with Rupau P.S. Case No. 101/2025. (Sandeep Kumar, J) tusharika/- U T
