The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 304(B), 120(B) of the Indian Penal Code and Section 3⁄4 of the D.P. Act. The case of the prosecution in brief as stated in the written report of the informant is that the son of the petitioners namely Rahul Kumar Yadav created an obscene video of the daughter of the informant in respect of which Baheri P.S. case No. 147 of 2018 was instituted against him and other coaccused persons. Thereafter, under social pressure, the
Patna High Court CR. MISC. No.9099 of 2020(2) dt.28-02-2020 2/3 informant solemnized the marriage of his daughter Priyanka Kumari with the co-accused Rahul Kumar Yadav. After marriage, the daughter of the informant went to her matrimonial house. Subsequently, the accused persons including the petitioners started demanding a vehicle and cash amount as dowry. It has been further alleged that the accused persons subjected the daughter of the informant to cruelty and torture of various kinds for fulfillment of their dowry demands. It is further alleged that petitioner no. 1 had even threatened the informant that his daughter will be eliminated if he failed to pay a sum of Rs. 10 lacs as dowry.
When the dowry demands of the accused persons were not made, they in collusion with each other killed the daughter of the informant by strangulating her. On receipt of the information of the death of his daughter, the informant rushed to the matrimonial house of his daughter and found the dead body of his daughter. The accused persons started putting pressure upon the informant to compromise the case and when the informant declined, they became furious and inclined to assault the informant.
Learned counsel for the petitioners submits that there is general and omnibus allegations upon the petitioners. He submits that petitioner no.1 is mother-in-law, petitioner no. 2 is
Patna High Court CR. MISC. No.9099 of 2020(2) dt.28-02-2020 3/3 father-in-law and petitioner no. 3 is devar of the victim. He submits that the husband of the victim is in custody since 23.09.2019.
In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.IX, Darbhanga in connection with Baheri Police Station Case No. 204 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
