The petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. The prosecution case in brief is that as per fardbeyan of informant Md. Junaid is that on 11.08.2019 at about 6.00 am morning he proceeded for village Fulwariya on his Pulsar motorcycle. On the way the informant was intercepted by three miscreants with Apache motorcycle. One of them fired causing injury to the informant and he was pushed down and speed away with motorcycle of the informant.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.13527 of 2020(4) dt.30-06-2020 2/2 petitioner is innocent and has falsely been implicated in this case. The petitioner has not named in the FIR and is in custody since 05.08.2020. There is neither any incriminating articles has been recovered from the possession of the petitioner nor his house. The name of the petitioner has been transpired from the confessional statement of co-accused namely Prince Kumar. The similarly situated co-accused has been bail by the Co-ordinate Bench of this Court vide order dated 28.02.2020 passed in Cr. Misc. no.11526 of 2020.

Learned APP for the State has opposed the prayer for bail petition.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each in connection with Bajpatti P.S. Case No. 270 of 2019 to the satisfaction of the learned SubDivisional Judicial Magistrate, Pupri, Sitamarhi. (Anjani Kumar Sharan, J) amitkumar/- U T
