First, in absence of any clear indication that the petitioner contract was extended and was subsisting when the 2006 Rules by a deeming fiction made such Panchayat Shiksha Mitra as a Panchayat Teacher. Secondly, no appointment or reinstatement is required to be made because mode of appointment on the post of a Panchayat Teacher itself has undergone a change by recent Rules where every candidate has to pass the Teacher Eligibility Test for

Patna High Court CWJC No.5424 of 2014 dt.29-02-2016 2/2 such recruitment. The argument being made on behalf of the petitioner is a futile exercise.
