JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 29-02-2016 The writ application is required to be dismissed now for more than one reason. First, in absence of any clear indication that the petitioner contract was extended and was subsisting when the 2006 Rules by a deeming fiction made such Panchayat Shiksha Mitra as a Panchayat Teacher. Secondly, no appointment or reinstatement is required to be made because mode of appointment on the post of a Panchayat Teacher itself has undergone a change by recent Rules where every candidate has to pass the Teacher Eligibility Test for

Patna High Court CWJC No.5424 of 2014 dt.29-02-2016 2/2 such recruitment. The argument being made on behalf of the petitioner is a futile exercise.

Writ is dismissed.
