JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Pakaridayal P.S. Case No. 147 of 2016, registered under Sections 341, 342, 384/34 and 120(B) of the Indian Penal Code. The accusation is that on receiving information about collecting of money forcibly to the vehicles by four persons at Pakaridayal Chowk, the Police reached there, where two persons succeeded to flee away, but petitioners were apprehended by the Police, who disclosed the name of their associates as Shankar Paswan and Vishwanath Paswan. On search, Tax Chungi receipt and cash of Rs. 3710/- were recovered from the possession of the petitioners.

Patna High Court Cr.Misc. No.12179 of 2017 (2) dt.22-03-2017 2/2 Learned counsel for the petitioners submits that, in fact, the petitioners were deputed by Subodh Kumar Singh, who had taken the contract of Nagar Panchyat to realize the tax and due to misunderstanding the petitioners have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent are in custody since 23.10.2016. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 5th Addl. Chief Judicial Magistrate, Motihari, East Champaran in connection with Pakaridayal P.S. Case No. 147 of 2016.
