Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in Mansi P.S. Case No. 72 of 2019 G.R. No. 1028/2019, registered for the offences punishable under Sections 363, 366A of the Indian Penal Code.
Patna High Court CR. MISC. No.11376 of 2020(2) dt.24-06-2020 2/2 The informant alleged that co-accused Lalchandra Sada had enticed away his minor daughter with the help of these petitioners.
It is submitted that petitioners have been falsely implicated in this case. There is general and omnibus allegation. The victim girl in her statement under Section 164 Cr.P.C has not stated anything about these petitioners. Moreover, other coaccused have been granted anticipatory bail by this court vide order dated 03.09.2019 passed in Cr. Misc. No. 55024 of 2019. The petitioners have got clean antecedent.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Khagaria in connection with Mansi P.S. Case No. 72 of 2019 G.R. No. 1028/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
