JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Narpatganj P.S. Case No. 01/2019, registered for offences punishable under Sections 30(a) 38(2) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 7.5 litres of liquor as well as 51 litres of Codine containing cough syrup from the petitioner. Apart from that he is accused in one more case. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the possession of the petitioner and he has been in judicial custody for more than two months and now chargesheet has been submitted, therefore, there is no chance of tampering with the evidence.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs.
