The petitioners apprehend their arrest in Bheldi P.S. Case No. 163 of 2013, registered for the offences punishable under Section 304B and other Sections of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The informant Punkal Mahto alleged that his daughter Putul Devi was married to Balmiki Mahto in the year 2010, but immediately after marriage her husband and other in-laws began to torture her. On 10.06.2014, the informant got information that Putul Devi and her six months child were poisoned to death. Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.4378 of 2015 (2) dt.03-02-2015 petitioners are sister-in-law, father-in-law, mother-in-law and brothersin-law of the deceased Putul Devi. The occurrence is said to have taken place on 10.06.2013, the informant got information on the same day about the death of his daughter, but the complaint petition was filed on 17.06.2013. The true facts are that the deceased died of burn injury accidentally during the course of cooking. The informant also filed a petition that he filed the case on wrong information.

Having considered the facts aforesaid and the fact that the petitioners are in-laws of the deceased and the informant has not made any sorts of specific allegation against the petitioners and it appears that the case is lodged after a week, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Chapra in connection with Bheldi P.S. Case No. 163 of 2013, Subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.)
