JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 Petitioners seek bail in anticipation of their arrest in connection with Barauni (Chakiya) P.S. Case No. 410 of 2017 registered for the offences punishable under Sections 364/34 of the Indian Penal Code.

Allegation as per FIR is that father of the informant was taken by the petitioners and others in order to kill him and thereafter he is traceless.

Submission of learned counsel for the petitioners is that as a matter of fact one Dhiraj Kumar was shot at by the father of informant while the petitioners and others were taking toddy and for that Barauni P.S.Case No. 409 of 2017 has been

Heard learned APP, who has drawn my attention towards paragraphs 7 and 8 of the case diary and it is stated that father of the informant and others shot at to Punit Mahton and thereafter people assembled and forcibly taken away the father of the informant and thereafter he is traceless. In view of above facts and circumstances and the case is still under investigation and the victim is still trceless, I am not inclined to grant the privilege of anticipatory bail to the petitioners.
