JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned counsel appearing for the State.

The petitioner seeks bail in Sadar P.S. Case No. 194/2016 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and 47 of Bihar Excise (Amd) Act, 2016. The petitioner is said to be arrested by the police while he was carrying liquor.

Earlier prayer for bail of the petitioner was rejected by this Court taking note of this fact that in huge quantity of Indian Made Foreign Liquor was recovered from the vehicle which was being driven by the petitioner but while rejecting the prayer for bail of the petitioner, this court gave liberty to the petitioner to renew his prayer for bail, if trial is not concluded within three months.

No.12707 of 2017 (2) dt.12-04-2017 2/2 The impugned order of the learned Sessions Judge goes to show that trial of the petitioner is still pending, moreover, the petitioner does not have any criminal antecedent and is languishing in jail since long, let the petitioner, named above be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge 2nd, Purnea, in S.T. Case No. 57/2017 in Sadar P.S. Case No. 194 of 2016.
