JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

It is alleged that the informant is under raiyat of the petitioner and used to work as domestic help. On 02.04.2014 when the informant went to demand wages then he was abused by calling caste name and assaulted. Again on 05.04.2014 the informant's 18 bags of paddy was unloaded by the petitioner and made assault.

It is submitted by learned counsel for the petitioner that for the initial occurrence of 02.04.2014 and subsequent occurrence of 05.04.2014 the F.I.R was registered on 10.05.2015. Moreover the accusation has been levelled in the background of dispute between the petitioner being raiyat

Patna High Court Cr.Misc. No.4490 of 2016 (2) dt.02-02-2016 2/2 and the informant being his under raiyat.

It is submitted by Mr. Ambika Bhagat, Special P.P that petitioner has been charge-sheeted and cognizance has been taken.

The delayed lodging of the case coupled with the accusation in the background of wage dispute between the parties, constitutes ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with SC/ST P.S. Case No. 12 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Begusarai.

It is expected from the learned Court below to dispose of the application, preferably on the same day. With the observations above, the application stands disposed off.
