The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 290 of the Indian Penal Code and 47(a) of the Excise Act. From the Form house of the petitioner 26 litres of country made liquor were recovered. The petitioner was found fleeing from the place of seizure.
It is submitted by learned counsel for the petition that generally in the form house the door and locks are not fixed. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.4579 of 2016 (2) dt.03-02-2016 2/2 Considering the quantity of recovery, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Madhepura (Bharrahi) P.S. Case No. 634 of 2015 pending in the court of learned Chief Judicial Magistrate, Madhepura. It is expected from the learned court below to dispose of the bail application of the petitioner preferably on the same day.
With the aforesaid observation, this application is disposed of.
