====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection Balthar P.S. Case no. 97 of 2020 registered for the offence punishable under section 414/34 of the Indian Penal Code read with section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that 50 liters country made liquor was recovered, apart from motorcycle bearing registration no. BR 22AG 7327 Learned counsel for the petitioner further submits that it is alleged that motorcycle was stolen one and the same did not belong to him nor there is any FIR registered with respect to the aforesaid motorcycle that the same has been stolen.

Patna High Court CR. MISC. No.21297 of 2021(2) dt.16-11-2021 2/2 Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 31.10.2020. charge sheet has been submitted and against petitioner, there is one criminal case as mentioned in para 3 of the petition, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Bettiah, West Champaran in Balthar P.S. Case no. 97 of 2020.
