The petitioners apprehend their arrest in Baheri P.S. Case No. 298 of 2012, registered for the offences punishable under Section 304B and other Sections of the Indian Penal Code. The informant, mother of the deceased alleged that her daughter Ghajala Parween was married to Md. Shamsher. The husband of the deceased and other in-laws started torturing her sometime after marriage and they burnt her to death while she was pregnant.
Learned counsel for the petitioners submits that the deceased got burnt injury while she was cooking. The matter was reported to police, statement of the deceased was also recorded at D.M.C.H. The FIR was lodged after many months of the
Patna High Court Cr.Misc. No.4005 of 2015 (2) dt.29-01-2015 occurrence. It is further submitted that the petitioners are married sister-in-law and cousin of the husband of the deceased. On perusal of record, it appears that the informant made omnibus and general allegation against the husband and all the family members of the husband of the deceased. The petitioners are married sister-in-law and cousin of the husband of the deceased.
Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Baheri P.S. Case No. 298 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
