02. In the present case, the petitioner is apprehending his arrest in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 332 of 2023, registered on 10.05.2023 for the offences under Sections 406, 467, 468/34 of the Indian Penal Code.
03. As per prosecution case, the petitioner and other co-accused persons got executed a fraudulent sale deed of the land of the informant by tampering with the document and giving false information.
04. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. The petitioner is merely a scribe and there is no specific allegation against the petitioner. The informant wanted to grab
Patna High Court CR. MISC. No.12435 of 2025(2) dt.21-02-2025 2/3 the property of the vendor of the co-accused Dhananjay Kumar since his vendor was having only two daughters. The widow of the vendor of co-accused went to Sub-Registrar, Lakhisarai wherein she stated that informant side wants to grab her land and her deceased husband sold his share of land in favour of coaccused Dhananjay Kumar. Learned counsel further submits that the petitioner is having antecedent of one case, which was registered against 12 persons including the petitioner and the petitioner is on bail in that case. Learned counsel further submits that the dispute is purely of civil nature.
05. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the civil nature of dispute and further considering the fact that petitioner is merely a scribe and also considering the possibility of false implication, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in
Patna High Court CR. MISC. No.12435 of 2025(2) dt.21-02-2025 3/3 connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 332 of 2023, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
