JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 622 of 2013 in which cognizance has been taken for the offences punishable under Sections 452, 380, 120B of the Indian Penal Code.

The contention on behalf of the petitioners is that petitioner no. 1 is cousin brother of the complainant and a land dispute is going on between the parties. It is further contended by him that two days prior to filing of the present case, petitioner no. 1 had filed complaint case bearing Complaint Case No. 595 of 2013 and in retaliation to filing of the aforesaid complaint case, the complainant has filed the present case against the petitioners.

Patna High Court Cr.Misc. No.4790 of 2015 (2) dt.05-02-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri R. K. Sinha, Judicial Magistrate 1st Class, Purnea in Complaint Case No. 622 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
