Petitioner is in custody in connection with Saharsa Sadar P.S. Case No. 197 of 2018 for the offence under sections 406, 420 and 379/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner was not named in the FIR. He has clean antecedent. Petitioner is in custody since 1.12.2018. He has been made accused in the instant case because he is brother of Bhimraj Yadav.

Learned counsel submits that petitioner and his family members are residing separate from his brother Bhimraj Yadav. Considering the fact that petitioner has no criminal
