The petitioner apprehends his arrest in Complaint Case No. 1151 of 2013, registered for the offence punishable under Sections 420, 467 and 468/34 of the Indian Penal Code. The complainant alleged that the petitioner and other accused persons fraudulently brought a sale deed in existence with regard to the land belonging to him.
Learned counsel for the petitioner submits that the petitioner and other accused persons are agnates of the complainant. They did not commit any fraud. A title suit bearing No. 123 of 2013 / 594 of 2013 has been filed by the complainant in the court of Sub-Judge, VI, Gaya with regard to the same land for declaration of sale deed illegal and void.

No.4018 of 2015 (2) dt.29-01-2015 2 / 2 Having considered the fact that the case appears to be of civil nature, petitioner Ajay Singh @ Ajay Kumar Singh, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Complaint Case No. 1151 of 2013, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
