2. In this case, the petitioner is seeking regular bail in connection with Dumraon P.S. Case No. 281 of 2023, registered for the offences punishable under Sections 363, 366A 376 of the Indian Penal Code & 6 of the POCSO Act and Section 9 of Protection of Children Marriage Act.
3. As per allegation, the daughter of the informant aged 17 years was missing since 19.06.2023. She went to a college for admission but she did not return. The informant searched for her but there was no trace of her.
4. From perusal of the records it appears that the
Patna High Court CR. MISC. No.14381 of 2024(5) dt.25-07-2024 2/2 victim did not support the prosecution case in her statement under Section 164 of the CrPC. She stated that on 19.06.2023, she fled away from her house and solemnized marriage with the petitioner. In paragraph No. 46 of the case diary, the age determination report of the victim by medical team has been annexed. The medical team found her age to be 21 years.
5. Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VI-cum-Special Judge, POCSO Act, Buxar in connection with Dumraon P.S. Case No. 281 of 2023, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
