Petitioner apprehends arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code as well as sections 3⁄4 of the Witch (DAAIN) Practices Act.
Prosecution's case, in brief, is that the petitioner, because of earlier dispute, came to the house of the informant and started hurling filthy words and on protest other accused persons also came there. It is further alleged that all the accused persons assaulted the informant and her family members and they took away Rs.1580/- from the pocket of informant's husband. Co-accused Nitu Kumari and Vikash Ram assaulted infromant's daughter with Garasa causing injury on her head. Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Parties are neighbour and the alleged quarrel took place on a trivial issue. Petitioner is a lady and has got no criminal antecedent. Considering the facts of the case, let the petitioner,

No.11152 of 2020(2) dt.17-06-2020 2/2 above named, in the event of surrender before the Court below, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in Yogapatti (Sanichari) Police Station Case No. 230 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
